State Council rejects Canalsat/TPS merger suspension request

The French State Council has rejected Canal+’s request to lift its injunction over the Canalsat/TPS merger set up by the Competition Authority.
The Council added that there is no condition of urgency and will rule on the full case before the end of the year. In addition it has judged that setting up injunctions before the full case be ruled was not endangering Canal+’s financial and economic situation.
The French Competition Authority had imposed new channel distribution injunctions in July to make the 2007 Canalsat/TPS merger respectful of competition rules. It has also enjoined Canal+ to sell its one-third stake in Orange cinéma séries.
