Dish creditors seek $8.8bn

Charlie Ergen’s Dish pay-TV and in particular the DISH Wireless division is facing a claim from unsecured creditors who have filed a motion in the US Bankruptcy Court for the Southern District of Texas over the transfer of assets held by Boost Mobile and in support of the creditors $8.8 billion (€7.6bn) in intercompany claims.

The motion argues the $8.8 billion claim was manufactured last August to control the vote on DISH’s prepackaged plan, not built over time through legitimate corporate lending. The asset shift was a “grossly inadequate consideration” says the claim.

Additionally, the creditors committee’s equity argument undermines reasonably equivalent value on Boost, since forgiving an investment contribution cannot be fair value for handing off a business the debtors valued in the billions.

The proposed $300 million release of EchoStar being addressed by the Court, paired with independent director retention, raises questions about whether the case structure can support contested claims objectively, says the claim.

The debtors say DISH Wireless received fair value for Boost through a reduction of the intercompany claim from more than $19 billion to $8.8 billion. The committee estimates Boost’s value and potential damages in the multiple billions.
