EchoStar wins TiVo ‘stay’

TiVo, not for the first time, will have to be patient before it can get its hands on Echostar’s money. Earlier this week EchoStar was hit with further penalties in its long-running DVR technology spat with TiVo.
Late on Wednesday both EchoStar and its sister business Dish Network Corp announced that they had applied to a Federal Appeal Court in Washington with an application to appeal against the District Court’s rulings. The Federal Court allowed a ‘stay’ to the decision pending the hearing of EchoStar’s appeals. Both EchoStar and Dish say they believe they have strong grounds for an appeal.
On Tuesday, the US District Court for the Eastern District of Texas ordered the enforcement of a permanent injunction against EchoStar and awarded TiVo an additional $103 million in the digital-video recorder patent dispute.
TiVo, in its statement, said it was "confident" the appeals court would again uphold Folsom "and not permit EchoStar to further delay this case once it has an opportunity to consider TiVo's response and EchoStar's motion on the ... stay."
